On April 15th, 2020, the State of Wisconsin passed Act 185 into law. The Act is largely in response to the COVID-19 pandemic. There are several provisions in the Act but this post is focused on the impact the Act has on worker’s compensation benefits for first responders.
Act 185 creates a rebuttable presumption that a COVID-19 injury to a first responder has been caused by that individual’s employment. The presumption requires a diagnosis or positive test for COVID-19 and the time period that the presumption will be in effect is between March 12, 2020 through 30 days following the termination of the Governor’s Executive Order 72.
While a good step for injured workers, Act 185 does not mean that injured first responders will have an “automatic” approval of their worker’s compensation claims. If this portion of Act 185 applies to you, or anybody you know, the attorneys at
